Official Rules

IMPORTANT: Please read these rules before entering the Six Flags Win a Wii Fit Sweepstakes (the "Sweepstakes"). By participating in this Sweepstakes (see How to Enter below), you (and your parent or legal guardian, if applicable) agree to be bound by these Official Rules and represent that you satisfy all of the eligibility requirements set forth below.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE OR PAYMENT WILL NOT INCREASE OR IMPROVE YOUR CHANCES OF WINNING. [If you are under the legal age of majority in your state of residence (a "Minor"), one of your parents or legal guardians must submit a signed, written statement that they have read, understood and agree to these Promotion rules with your entry, and that such agreement constitutes acceptance of these Promotion rules on behalf of you and themselves.]

1. SPONSOR. The Sweepstakes is sponsored by Six Flags Theme Parks Inc., c/o Six Flags, Inc.,
   1540 Broadway, 15th Floor, New York, NY 10036 ("Sponsor").
 
 
2. ENTRY PERIOD. This Sweepstakes entry period begins at 12:01 a.m. Eastern Time ("ET") on Friday, August 1, 2008 and ends at 11:59 p.m. ET on Wednesday, August 27, 2008 (the "Entry Period"). All entries must be completed during the Entry Period and received within three (3) days after the end of the Entry Period to be eligible to win a prize.
 
 
3. ELIGIBILITY. This Sweepstakes is only open to entrants who, as of the entry date, are legal residents of the fifty (50) United States or the District of Columbia and who are at least thirteen (13) years old. This Sweepstakes is void outside the fifty (50) United States and the District of Columbia, and where prohibited or restricted by law. Employees, officers and directors of Sponsor and Nintendo of America, Inc., and their respective parents, subsidiaries, affiliates, divisions, advertising and promotion agencies, and the immediate families (defined as parents, spouses, children, siblings, grandparents, and their respective spouses) or members of the same household (whether related or not) of each such employee, officer and director, are not eligible to enter or win a prize. This Sweepstakes, and any website pages and advertisements relating thereto, is intended for viewing only within the United States and the District of Columbia, and entrants must be present in the fifty (50) United States or the District of Columbia at the time they enter.
 
 
4. HOW TO ENTER; SUBMISSIONS. There are two (2) ways to enter this Sweepstakes:
   
   a. ONLINE METHOD OF ENTRY:  During the Entry Period, go to www.sixflags.com/national/footernav/wiifit.aspx to the Sweepstakes section of the website and follow the links and instructions for online entry. Completely fill out the online entry form and submit it in accordance with the on-screen instructions. In the event of a dispute as to the identity of an online entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant. Potential winners may be required to show proof of being the authorized account holder. The "authorized account holder" is the natural person assigned to an email address by an Internet service provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address. All entries will be deemed to have been made by the authorized account holder of the submitted email address. Submitting mass entries or entries generated by a script, macro or use of automated devices is prohibited and will result in disqualification. Online entrants are automatically registered to receive Sponsor's e-newsletter "Team Six."
   
   b. MAIL-IN METHOD OF ENTRY: During the Entry Period, hand print or type on a 3" x 5" piece of paper your name, complete home address, day and evening phone numbers, email address (if available), and age (including year of birth), and mail in an envelope with correct U.S. postage affixed to "Six Flags Win A Wii Fit Sweepstakes," Six Flags Theme Parks Inc., c/o Six Flags, Inc., Attn: SM, 1540 Broadway, 15th Floor, New York, NY 10036. Sponsor is not responsible for lost, late, stolen, incomplete, invalid, unintelligible, illegible, damaged, mutilated, altered, misdirected or postage-due entries, which will be disqualified. No facsimiles, photocopied or mechanically reproduced entries allowed. Use of any automated system to submit entries is prohibited and will result in disqualification.
   
   c. FOR ALL ENTRIES: You may enter as often as you wish, regardless of method of entry. Failure to submit all required information in the manner required in these Official Rules may result in disqualification. All entries become the exclusive property of Sponsor and none will be acknowledged or returned. Proof of online submission or mailing will not be deemed to be proof of receipt by Sponsor. All entrants and entries are subject to verification by Sponsor. Any submission that does not comply with any aspect of these Official Rules may be rejected by Sponsor and the entrant disqualified. See Section 14 below ("Data Collection; Promotional Materials") regarding data collected in connection with an entrant's entry and an online entrant's ability to decide whether or not Sponsor may share such information with third party partners.
 
 
5. AGREEMENT TO DECISIONS OF SPONSOR. By participating in this Sweepstakes, each entrant (and his/her parent or legal guardian, if applicable) fully and unconditionally agrees to be bound by and accepts these Official Rules and the decisions of Sponsor (including, without limitation, decisions regarding eligibility of entries, the selection of winners, and the awarding of prizes), which are final and binding in all respects.
   
   Sponsor reserves the right to conduct a background check on any or all entrants, and Sponsor reserves the right in its sole discretion to disqualify any individual based on such background check if Sponsor determines in its sole discretion that awarding a prize to any such individual might reflect negatively on Sponsor. Participants will cooperate with Sponsor and its representatives in connection with any and all verification and background check activities.
 
 
6. DRAWING; ODDS. Sponsor will randomly select (a) one (1) potential grand prize winner and
   (b) fifty (50) potential secondary prize winners for this Sweepstakes from all eligible entries received by Sponsor during the Entry Period. Both drawings will be held on or about Monday, September 22, 2008. Odds of winning depend on the number of eligible entries received by Sponsor in this Sweepstakes. The entrant selected (and if applicable, his/her parent or legal guardian) must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. 
 
 
7. NOTIFICATION. A potential prize winner will be notified by telephone. If the potential winner is not present at the time of the call and a telephone message can be left by Sponsor at that time, he/she will have forty-eight (48) hours to return the call and accept the prize. A potential prize winner will be required to execute and return to Sponsor an Affidavit of Eligibility, a Liability Release and (where lawful) a Publicity Release, in order to claim the prize. Such documents must be returned to Sponsor within the time period specified by Sponsor. For a potential winner who is a minor in his/her state of residency, the minor's parent or legal guardian must also verify and confirm the entrant's and such parent's or legal guardian's agreement to such Affidavit of Eligibility, Liability Release and Publicity Release in the documents provided by Sponsor in order to claim the prize. If a telephone message cannot be left by Sponsor at a potential prize winner's phone number when the Sponsor places the notification call, or if the potential prize winner does not return the notification call within forty-eight (48) hours of Sponsor's first attempt to contact the potential prize winner by telephone, or if the potential winner fails to return the required documents within the required document return period (which documents include the Affidavit of Eligibility, Liability Release, Publicity Release, and any parent or guardian authorizations and agreements), or if the potential winner is found to be ineligible, or if the potential winner does not comply with these Official Rules, then the potential winner may be disqualified and an alternate potential prize winner selected by Sponsor in his/her place at random from among the remaining eligible non-winning entries received by Sponsor for the Sweepstakes. In such event, an alternate potential prize winner will be notified by Sponsor by telephone as described above and will be required to return the required documents to Sponsor as described above, however, Sponsor, in its sole discretion, may adjust the above timing and delivery requirements to accommodate Sponsor's sweepstakes schedule. Sponsor is not responsible for the failure of a potential winner to receive Sponsor's telephone message or the required documents for any reason, or for the inability of such potential winner to return Sponsor's telephone message or the required documents for any reason. In the event of a prize forfeiture, no compensation or other payments will be given.
 
 
8. PRIZES. Subject to these Official Rules, one (1) grand prize will be awarded in this Sweepstakes and fifty (50) secondary prizes will be awarded in this Sweepstakes. The grand prize consists of and is limited to one (1) Wii™ console and (1) Wii Fit™ video game for the Wii console. The approximate retail value of the grand prize is $339.98. The secondary prize consists of and is limited to one (1) Wii™ Yoga Mat. A total of fifty (50) secondary prizes will be awarded in this Sweepstakes. The approximate retail value of each secondary prize is $29.99. The aggregate retail value of all prizes to be awarded in this Sweepstakes is $1,839.48. THE Wii™ CONSOLE, WHICH IS PART OF THE GRAND PRIZE, CONSISTS OF AND IS LIMITED ONLY TO THE BASE MODEL UNIT AND OTHER ITEMS WHICH ACCOMPANY A BASE MODEL UNIT IN ITS BOX.  ADDITIONAL SERVICES AND/OR ITEMS ARE OR MAY BE REQUIRED TO USE THE GRAND PRIZE, AND THOSE SERVICES AND ITEMS ARE NOT INCLUDED WITH THE GRAND PRIZE BUT MUST BE PURCHASED OR OTHERWISE OBTAINED AT THE WINNER'S TIME AND EXPENSE IN ORDER TO USE THE GRAND PRIZE. Prizes won by a Minor will be awarded to a parent or legal guardian on the minor's behalf. All prizes must be accepted as awarded, and all prizes are awarded "AS IS" with no warranty (beyond any warranty provided with the prize itself) representation, or guarantee, express or implied, in fact or in law, made by Sponsor or its sweepstakes partners or prize suppliers or for which Sponsor, its sweepstakes partners or prize suppliers shall be liable, including, without limitation, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. No substitution, assignment or transfer of any prize is permitted, except by Sponsor, who reserves the right (but has no obligation) to substitute any prize (or a component thereof) with another prize of greater or equal value, including cash, if the prize is not available for any reason as determined by Sponsor in its sole discretion. Each winner is solely and fully responsible for any and all costs, fees, taxes and expenses associated with prize award, receipt and use, including, without limitation, all federal, state and local taxes on the prize.
   LIMIT: One (1) prize per person/family/household/e-mail address.
   
   Each winner will be issued a United States Internal Revenue Service 1099 tax form for the approximate retail value of the prize.
 
 
9. PUBLICITY. Except where prohibited by law, participation in this Sweepstakes constitutes winner's consent to Sponsor's (and its successors', assignees' and designees') use of winner's name, biography, likeness, voice, photographs, video, opinions, hometown, state and country for promotional purposes in any manner or media (including, without limitation, online), worldwide, in perpetuity, and without further payment, consideration, notice or consent.
 
 
10. GENERAL CONDITIONS. Sponsor reserves the right, in its sole discretion, to terminate, modify or suspend this Sweepstakes if, in Sponsor's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of this Sweepstakes, or if viruses, bugs, unauthorized intervention, fraud, technical difficulties, acts of God, or failures or any other factor beyond Sponsor's reasonable control corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes. In such event, Sponsor reserves the right in its sole discretion (but has no obligation) to award the prize(s) at random from among eligible, non-suspect entries received up to the time of suspected impairment.  Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of this Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any website or undermine the legitimate operation of this Sweepstakes is a violation of criminal and civil laws, and, should such an attempt be made, Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision or any other provision of these Official Rules.
 
 
11. RELEASE. By entering the Sweepstakes, each entrant, (and, if you are a minor, your parents or legal guardians), forever and irrevocably releases and holds harmless Sponsor, its parents, subsidiaries, divisions and affiliates; Nintendo of America, Inc., its parents, subsidiaries, divisions and affiliates; and each of their respective agents, advertising and promotion agencies, affiliates, sweepstakes partners and prize suppliers, and all of their respective employees, officers, directors, shareholders and agents (collectively, the "Released Parties") from and against all claims, damages or liabilities arising in whole or in part, directly or indirectly, from entrant's participation and/or entry in this Sweepstakes and/or entrant's award, receipt or use of any prize awarded in this Sweepstakes.
    
    IF YOU ARE A MINOR, YOUR PARENTS OR LEGAL GUARDIANS  FURTHER AGREE TO INDEMNIFY EACH OF THE RELEASED PARTIES FROM ANY claims, costs, injuries, losses, or damages DESCRIBED IN THE PRECEDING PARAGRAPH WHICH MAY BE SUFFERED BY YOU.
 
 
12. LIMITATIONS OF LIABILITY. Neither Sponsor nor its sweepstakes partners or prize suppliers are responsible for: (a) incorrect or inaccurate transcription of entry information or late, lost, stolen, unintelligible, illegible, damaged, mutilated, altered, incomplete, misdirected or postage due entries or entries received through impermissible or illegitimate channels, all of which will be disqualified; (b) technical failures of any kind, including but not limited to the malfunctioning of any telephone, computer online systems, computer equipment, website, server provider, network, hardware or software; (c) the unavailability or inaccessibility of any website or service;
    (d) unauthorized intervention in any part of the entry process or this Sweepstakes; (e) printing, typographical, electronic or human errors which may occur in the offer or administration of this Sweepstakes or the processing of entries; or (f) any injury or damage to persons or property, including but not limited to entrant's computer, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in this Sweepstakes, or from viewing, playing or downloading any material from Sponsor's website, regardless of whether the material was prepared by Sponsor or a third party, and regardless of whether the material is connected to Sponsor's website by a hypertext link.
 
 
13. DISPUTES. Entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in a federal or state court located in New York, New York; entrant submits to sole and exclusive personal jurisdiction to said courts in the State of New York for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (b) any and all claims, judgments, and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys' fees; and (c) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant or Sponsor in connection with this Sweepstakes shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of New York, the United States, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.
 
 
14. DATA COLLECTION; PROMOTIONAL MATERIALS. Entrants provide personal information on the entry form when they enter this Sweepstakes. Sponsor collects this information and uses it (a) to administer this Sweepstakes and (b) for market research and for other marketing purposes.  Sponsor may share this information with third parties who need access to this information to perform services on Sponsor's behalf. When entering online at the Sweepstake's website, you will be automatically registered to receive Sponsor's
    e-newsletter "Team Six"; mail-in entrants are not automatically registered [Note: recommend having a means of opting out of receiving the e-newsletter in the first e-newsletter sent to participants.]. Additionally, when entering online at the Sweepstake's website, you may be asked to consent to receive promotional emails and information about or from Sponsor and/or its marketing partners.  You will be given an opportunity to "opt-in" to (i) receive such marketing or promotional communications from Sponsor; and (ii) allow Sponsor to share your information directly with its third party partners so that they can send marketing or promotional communications directly to you. Consenting to receive such emails and to share your information (by "opting in") is optional, and is not necessary to enter or win this Sweepstakes, nor will it increase or improve your chances of winning. For more information about the ways Sponsor uses and shares personal information collected through its website, please see the Privacy Policy of Sponsor located at http://www.sixflags.com/national/footerNav/PrivacyPolicy.aspx. Personal information collected through mail-in entries will only be used to administer this Sweepstakes.
